Referral Terms and Conditions

Overview of the Duo Design Referral Programme
The Duo Design referral programme allows existing customers of Duo
Design to earn 5% commission on any new customers introduced to Duo
Design. This 5% is based on 5% of the first invoice Duo issues to
the refereed client.

Eligibility
1. The Programme is only open to existing Duo Design customers and
all referrals must be received within 30 days of an invoice issued
to the referrer. The Program is void where prohibited by the
exiting employment conditions or other terms and conditions in
place in restriction to the person or company receiving the
commission.
2. Participation in the Program constitutes the Participant’s
full and unconditional agreement to these Terms and Conditions.

Program Period
This offer is currently only open to clients who have received
invoice between the 1st September 2004 and the 31st March 2007

Modifications and Termination of the Program
Duo Design reserves the right to modify any of the terms and
conditions set forth herein – including, but not limited to,
the methods through which customers may earn commission and
the amount of commission that can be earned by referring
clients – at any time, with or without notice, even though
these changes may affect a customer’s ability to receive
commission.
A customer’s participation in the Program constitutes the
customer’s acceptance of any changes to these Terms and
Conditions. Customers are responsible for remaining knowledgeable
as to any changes that Duo Design may make to these Terms and
Conditions. The most current version of these Terms and Conditions
will be available at duointernet.com/profile/referral and will
supersede all previous versions of these Terms and Conditions.
All questions or disputes regarding eligibility for the Program,
earning of commission, or a customer’s compliance with these
Terms and Conditions will be resolved by Duo Design in its sole
discretion.

Limitation of Liability
Except where prohibited, Customer agrees that: (a) any and all
disputes, claims, and causes of action arising out of or connected
with the Program shall be resolved individually without resort to
any form of class action. (b) any and all claims, judgements and
awards shall be limited to actual out-of-pocket costs incurred
(i.e.,only costs associated with participating in the Program), but
shall not include legal fees under any circumstances; and
(c) Referrers hereby waives all rights to claim punitive,
incidental, and consequential damages.
If any provision of these Terms and Conditions is found to be
invalid or unenforceable by a court of competent jurisdiction, such
provision shall be severed from the remainder of these Terms and
Conditions, which will otherwise remain in full force and effect.

Governing Law and Jurisdiction
These terms will be governed by and construed in accordance with
the laws of England and Wales and both parties submit to the
non-exclusive jurisdiction of the courts of England and Wales
